Aiva – Customer Terms & Conditions

1. Introduction & Scope

This document explains the terms and limitations of the AI-powered features offered through the Aiva platform, including but not limited to the AI chatbot, personalized product recommendations, and future voice-based assistants (collectively, the “AI Assistant”).

These features are intended to enhance your shopping experience by offering smart suggestions, assisting with store discovery, and automating product search and selection.

By enabling or using the AI Assistant on Aiva, you:

  • Acknowledge that you have read and understood this disclaimer
  • Agree to be bound by Aiva’s Terms & Conditions, Privacy Policy, and this AI usage policy
  • Consent to the storage and processing of your AI interactions for personalization, service improvement, and operational analytics

If you do not agree with any part of this policy, you must not use the AI features on the Aiva platform.


2. Subscription-Based Access

The AI Assistant is offered exclusively as a subscription-based service. Access is restricted to users with an active paid subscription.

Subscription Terms:

  • Eligibility: Only registered users with verified accounts may purchase a subscription
  • Plans: Subscription tiers (monthly, quarterly, or annual) and pricing are displayed within the app before purchase
  • Scope: Each plan may limit the number of AI queries, voice interactions (if enabled), or usage hours
  • Auto-Renewal: Unless cancelled manually, subscriptions may auto-renew at the end of each billing cycle
  • Payment Gateway: All subscriptions are processed securely through Razorpay or other approved payment methods

Cancellation & Refunds:

  • Subscriptions can be cancelled at any time through your account settings
  • However, no partial refunds will be issued for unused time, unless required by law
  • If access is terminated due to violation of this policy (e.g., abuse, automation, spamming), you will not be entitled to a refund

Aiva reserves the right to change pricing, feature limits, or availability of AI services at any time, with prior notice in the app.


3. How the AI Assistant Works

The AI Assistant is powered by third-party large language models (LLMs), including technology licensed from OpenAI. It uses natural language processing to interpret your messages and respond with automated suggestions or answers.

The assistant may be used for the following purposes:

  • Help you discover relevant stores, products, or offers
  • Provide general grocery-related information (e.g., recipes, substitutions, product types)
  • Recommend personalized items or reorder options based on your purchase history
  • In future versions: respond to voice input and complete cart additions or order placements

Please note:

  • The AI Assistant is not human — it cannot guarantee the accuracy, completeness, or appropriateness of its responses
  • It does not provide any legally binding advice, health recommendations, or certified expertise
  • You should always verify important details manually before making decisions based on AI suggestions

Aiva is not responsible for any direct or indirect damages arising from the use or reliance on AI-generated responses.


4. Limitations of the AI Assistant

While our AI Assistant is designed to improve your experience on Aiva, it remains an experimental, automated tool with known limitations.

You acknowledge and agree that:

  • Responses are generated by artificial intelligence and may not always be accurate, complete, or contextually appropriate
  • The Assistant may misinterpret your input, generate outdated responses, or provide suggestions unrelated to current inventory or local availability
  • The Assistant does not verify store offers, product availability, delivery slots, or pricing in real-time
  • It is not a substitute for customer support, store contact, or legal, financial, or health guidance
  • Use of AI is entirely at your own discretion and risk

Aiva provides the AI Assistant on an “as-is” basis and makes no warranties, express or implied, about its performance, usefulness, or reliability. No feature should be construed as offering guaranteed support or platform commitments.


By using the AI Assistant — including voice or chat interactions — you explicitly consent to the following:

A. Collection & Storage

  • Aiva may store, log, and archive your AI interactions, including queries, responses, and metadata such as time and device ID
  • For voice-enabled features (when available), voice inputs will be converted to text, stored temporarily, and linked to your account history

B. Analysis & Personalization

  • We may analyze your messages to:

    • Improve platform responses and system performance
    • Detect fraud, misuse, or technical errors
    • Offer more accurate recommendations based on your past orders or behavior
  • Conversations may be reviewed by Aiva’s internal team for quality control, training, and moderation purposes

You may request deletion of your AI chat history by contacting our support team, subject to any applicable retention requirements for fraud prevention or platform integrity.


6. AI-Based Personalization Logic

The AI Assistant and personalization systems may use your data to:

  • Recommend stores or products based on your search and order history
  • Auto-fill carts with frequently ordered items
  • Suggest relevant discount codes or free delivery eligibility
  • Prioritize results from nearby or high-rated stores
  • In future versions, display sponsored product placements, clearly labeled as such

All personalization is automated using in-app behavioral data, and may not always reflect live inventory or preferences. Users may opt out of non-essential personalization (once that setting is available in your account panel).


7. Fair Usage & Abuse Handling

To ensure consistent and fair service to all subscribers, Aiva may enforce usage limits or take action against misuse of the AI system.

Prohibited Usage Includes:

  • Using bots, scripts, or automation to send queries or scrape responses
  • Sharing your AI subscription with others or using it for commercial reselling
  • Submitting spam queries, inappropriate content, or abusive commands
  • Attempting to reverse-engineer the AI system or access backend prompts

Enforcement Measures:

  • Aiva may limit daily/monthly AI interactions based on your subscription plan
  • Accounts found violating this policy may have their AI access suspended or terminated
  • No refunds will be issued for suspension due to abuse

Usage policies may evolve as our AI tools expand or as we onboard more users. Aiva reserves the right to apply usage tiers, content moderation tools, or escalation limits based on real-world performance.


8. Policy Updates & Feature Changes

Aiva’s AI and personalization features are evolving technologies. We may:

  • Add or remove capabilities (e.g., voice commands, multi-language support, smart reordering)
  • Adjust subscription pricing, access tiers, or usage limits
  • Change the underlying AI provider or processing models (e.g., shift from OpenAI to another partner)
  • Modify how personalization works based on new data laws, feature expansions, or user feedback

We reserve the right to update this disclaimer at any time. If changes materially affect your rights or obligations:

  • We’ll notify you via the app or email (if enabled)
  • The updated policy will take effect once published in-app

Your continued use of the AI Assistant after changes constitutes acceptance of the revised policy.


9. Limit of Liability

To the fullest extent permitted by law, Aiva, its officers, employees, partners, and affiliates shall not be liable for:

  • Any direct, indirect, incidental, or consequential damages
  • Loss of data, business opportunity, reputation, or revenue
  • Errors, inaccuracies, or omissions in AI-generated content
  • Misuse, abuse, or unauthorized access to your AI activity

This limitation applies even if you have informed us of the possibility of such damage.

Your sole remedy for dissatisfaction with AI features is to stop using the feature or cancel your subscription.

We strive to respond to all AI-related support queries within 48 working hours. Voice issues (once live) may require longer resolution depending on the complexity.


By enabling or continuing to use Aiva’s AI Assistant, you:

  • Confirm that you have read and understood this disclaimer
  • Consent to the collection and use of your chat/voice data as described above
  • Accept that the AI service is experimental and used at your own discretion
  • Agree to comply with all usage rules, subscription terms, and fair-use limits

If you disagree with any part of this disclaimer, please do not use or activate the AI Assistant.
